This Privacy Policy describes the policies and procedures of Ollie LLC (“Ollie,” “we,” “our” or “us”) and applies to information collected in connection with the products and services that Ollie offers.  This includes information collected online through our websites, branded pages on third party platforms (i.e, social networking services, social media sites), mobile applications, and through our direct marketing campaigns or other online communications, as well as offline through our events and mobile messaging services (collectively, “Ollie Services”).

 

This Privacy Policy explains what information may be collected through the Ollie Services, how such information may be used and/or shared with others, how we safeguard it and how you may access and control its use in connection with our marketing communications and business activities. This Privacy Policy is hereby incorporated into and forms part of the terms and conditions of use of the Ollie Services.

 When you visit www.olliesmile.com or otherwise use the Ollie Services, you are consenting to the collection, use, transfer, manipulation, storage and disclosure of your information as described in this Privacy Policy.  If you do not, please do not use the Ollie Services.

 

ACCOUNT INFORMATION AND INFORMATION COLLECTION INFORMATION YOU PROVIDE TO US

 When you use the Ollie Services or create an Account, you will voluntarily provide certain personal information to obtain our products or use our services.  For example, we (or our service providers or business partners) may ask for and collect information that relates to you, including personal informationsuch as your name, email address, telephone number, shipping address, date of birth, gender, and demographic information.  Some information collected may be information when you register to create an account, update your information, sign up for a subscription, use certain features, access, upload or download content, purchase products or services, enter into promotions, fill out a survey, request customer support, or otherwise communicate with us.  

We may also collect information including, but not limited to, information about your shopping habits, lifestyle preferences, interests and hobbies, health, physical or behavioral characteristics, or other demographic information, as well as photos, videos, and other user-generated content. 

Some features of the Services may now or in the future allow you to provide content, such as written comments or reviews, to the Services, including through Social Media Services as described above. All content submitted by you to the Services, including through Social Media Services, may be retained by us indefinitely, even after you terminate your Account. We may use or continue to disclose such content to Business Partners as permitted by this Privacy Policy.

 INFORMATION REGARDING SOCIAL MEDIA AND SOCIAL NETWORKS

 You may also be given the option to link to your Facebook or other social media accounts through the Ollie Services. When you do, we may automatically receive certain information from you based upon your privacy settings on those sites. This may include, but may not be limited to, name, user name, demographic information, updated address or contact information, location, interests, and publicly-observed data, such as from social media and online activity.

When you use social media sharing tools or tag or mention us or our products, or otherwise interact with us through Social Media Services, you acknowledge and agree that some information and content relating to your account on the applicable Social Media Services may be transmitted to us, and that our use of such information is covered by this Privacy Policy, and you hereby allow us to use such information or content in connection with our business, including across our properties and for commercial purposes, or as otherwise permitted by this Privacy Policy. Furthermore, when you use these tools or post to our Services, we may share some of your information and content from our Services with certain Social Media Services, including through our branded pages on such Social Media Services, and such information and content would be subject to the privacy policies of such Social Media Services.

SHIPPING AND BILLING INFORMATION

If you make a purchase from us, you will be required to provide a credit/debit card number and related financial information (such as CVV, expiration date, and billing address), or other payment information (such as via PayPal), depending on the form of payment you choose, telephone number and shipping address.   Please note that your financial information, such as your payment method (valid credit card number, type, expiration date or other financial information) is used and stored by our Payment Processor, and use and storage of that information by the Payment Processor is governed by the Payment Processor’s applicable terms of service and privacy policy.

 INFORMATION COLLECTED AUTOMATICALLY

 Generally, the Ollie Services, Ollie as well as any third-party advertisers and/or service providers automatically collect certain usage information, such as the number and frequency of visitors to the Ollie Services that we may use in aggregate or anonymized form. This type of aggregate data enables us and third parties authorized by us to better understand our Services, such as by helping us figure out how often individuals use parts of the Ollie Services, Subscriptions or Products so that we can analyze and improve them. We also automatically receive and record information from your web browser when you interact with the Ollie Services, such as your IP address, browser type, ISP, referring/exit pages and cookie information. We may also collect device-specific information about the device you use to access the Services, such as unique device identifiers, network information and hardware model, as well as information about how the device interacts with our Ollie Services and information about where you access the Ollie Services from. This information is used for purposes such as facilitating analyses of data concerning registered and unregistered users’ interaction with the Ollie Services (e.g., what links you have clicked on). Non-Personal Information (defined below) that we automatically collect may be combined by us or our Business Partners with other information about you, including Personal Information, and used in connection with our business or to provide you with information, products and services that we believe may be of interest to you.

 ANALYTICS AND THIRD PARTY SERVICE PROVIDERS

 We may use one or more third party service providers such as Google Analytics, Ad servers, Ad agencies, Facebook Custom Audience and others, for analytics and advertising services such as to provide audience measurement and analytics services to us, to serve ads on our behalf, to track and report on the performance of those advertisements, to collect information via the Services for marketing and advertising purposes, and to identify people who are most likely to respond to our advertisements.

 These service providers may use technology tracking tools such as cookies, web beacons, pixel tags, log files, or other technologies to receive, collect, and store personal and non-personal information on our behalf. They may also combine information they collect from your interaction with the Ollie Services with information they collect from other sources. We do not have access to, or control over, these third parties’ use of cookies or other tracking technologies.

 We may obtain information about you from other trusted third party sources to update or supplement the information that you provide or that we collect automatically. This includes, for example, information from public databases or data aggregators that may include your demographic information, media consumption, previous purchases, shopping habits, loyalty program information or lifestyle preferences. We may also receive information about you from our partners and service providers, (including, for example, business partners, analytics vendors, advertising networks and search information providers).  

 In connection with these services, we and/or these Third Party Services may use cookies, web beacons, pixel tags, mobile analytics software, log files, or other technologies to collect certain information about your online activity, and interactions with our emails, online and mobile advertisements, and to allow us to keep track of analytics and certain statistical information which enables Ollie to improve the Ollie Services and provide you with more relevant content and advertising offered by Ollie, or through or linked from the Ollie Services.

 We may automatically or passively collect certain non-personal information from you, including information such as IP address, web browser, pages viewed or Unique Identifier for the device (computer, mobile device, tablet, etc.) you use to access Ollie Services and also the location of your Device when you access or use the Ollie Services. We may also collect activations, content, products or services you purchase or access, the page served and the preceding page views or websites visited, any mobile device activity and configurations, and email client. We may also automatically collect information about your use of the Ollie Services, including the date and time you visit the Ollie Services, use or click through to any of the Ollie Services, the areas or pages of the Ollie Services that you visit, the amount of time you spend viewing or using the Ollie  Services, the number of times you return to the Ollie Services, other click-stream or site usage data, emails that you open, forward or click-through to our Ollie Services, and other sites that you may visit.

 We may use this information to help us maintain the accuracy of the information we collect, personalize your experience with the Ollie Services, target our communications so that we can inform you of products and services or other offers that may be of interest to you, to measure ad quality and responses, and for internal business analysis or other business purposes.

 We may combine the information we receive from you and about you, including information you provide to us and information we automatically collect through the Ollie Services, as well as information collected across other computers or devices that you may use, from other online or offline sources, and from third party sources.  This combined information may be used in any manner detailed in this Privacy Policy.

 HOW WE USE THE INFORMATION COLLECTED

 We may use the information about you for a variety of business purposes including but not limited to customer service (responding, managing and troubleshooting questions or issues with your account and registration or to contact you regarding use of Ollie services)) and transactional purposes such as verifying identity, validating shipping information, to protect the integrity and security of Ollie Services.

 Other instances where we may use the information is for advertising customization and Analytics purposes such as but not limited to personalizing and improving the Ollie Services, product offerings and offers made available; to provide you with more customized content and offers on behalf of Ollie and its partners or affiliates; to communicate with you for promotional and advertising purposes and to understand your needs.

 Your activity in connection with the Ollie Services, such as filling out surveys, reviewing and rating products, inquiring about or purchasing products, participation in online communities, “liking” or “sharing” Ollie content to your social media accounts or pages or otherwise interacting with the Ollie Services, may be visible to other users of the Ollie Services and in some cases, publicly available.

We may share your information with third party service providers that provide business, professional or technical support functions on our behalf. This includes, but may not be limited to, service providers that host or operate the Ollie Services; payment processors; analyze data; provide customer service; postal or delivery services, and sponsors or other third parties that participate in or administer any promotions.

 Your information may also be shared with other Third Parties like our sponsors, partners, advertisers, advertising networks, advertising servers, and analytics companies or other third parties in connection with marketing, promotional, and other offers, as well as product information. Your information may also be shared with third parties we identify at the time you provide your personal information or otherwise with your consent.   

 AFFILIATES

We may share your information with our subsidiaries and affiliated companies for internal reasons, primarily for business and operational purposes.   

 BUSINESS TRANSFERS

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is often one of the transferred business assets. In the event that another entity acquires us or all or substantially all of our assets, or assets related to the Ollie Services, your information may be disclosed to such entity as part of the due diligence process and will be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties. Finally, information described in this paragraph may also be disclosed for due diligence purposes in connection with any proposed transaction of the sorts described in this paragraph.

 LEGAL DISCLOSURES FOR OUR PROTECTION AND PROTECTION OF OTHERS

Ollie may transfer and disclose your information to third parties to comply with a legal obligation We reserve the right to access, read, preserve and disclose any information as we reasonably believe is necessary to:

1) Satisfy any applicable law, regulation, legal process or governmental authorities request

2) Enforce this Privacy Policy and our Terms of Service, including investigation of potential violations hereof or thereof

3) Detect, prevent, or otherwise address fraud, security or technical issues

4) Respond to user support requests

CHOICES REGARDING YOUR INFORMATION AND OPT-OUT

  1. You can use some of the features of the Services without registering, thereby limiting the type of information that we collect. You can always opt not to disclose certain information to us, but please note that certain information may be needed to take advantage of some of our Services.
  2. You can update and/or delete the Personal Information in your Account profile by visiting your Account.
  3. You can delete your Account. Please note that we will need to verify that you have the authority to delete the Account, and activity generated prior to deletion will remain stored by us.
  4. Your browser may offer you a “Do Not Track” or “DNT” option, which allows you to signal to operators of websites and web applications and services (including, without limitation, behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. The Services do not support Do Not Track requests at this time, which means that we may collect information about your online activity both while you are using the Services and after you leave our properties.   5. You can choose to opt out of certain communications or communication methods; however, if you do so, you may not be able to take advantage of some of our Services’ best features. Please note that even if you opt-out, you may still receive advertisements from Ollie that are not customized based on your Usage Information.
  6. You can opt out of certain Tracking Tools by following the steps set forth in the section above titled “Analytics and Advertising Services Provided by Others”.

Unsubscribe from our marketing email communications at any time by unsubscribing or following the instructions contained within the email.

Should you ever decide to delete your Account, you may do so by emailing us at info@olliesmiles.com.  If you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account.

 GOVERNING LAW

This Policy is governed by the laws of the State of Georgia, U.S.A. without giving effect to any principles of conflict of law.

 YOUR CALIFORNIA PRIVACY RIGHTS

 If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by the Company to third parties for the third parties’ direct marketing purposes. With respect to these entities, this Policy applies only to their activities within the State of California.

You use the Ollie Services and provide us with your information at your own risk.  If we share information with a third party, as detailed in this privacy policy, we shall use all reasonable efforts to ensure that they keep the information secure and only use the information consistent with the terms of this Privacy Policy.

 OTHER SITES 

 The Ollie Services may contain links to other sites that we do not own or operate. This includes links from service providers, fulfillment companies, advertisers, sponsors, or other business partners that may use our logo(s) as part of a co-branding agreement. We are not responsible for these sites or their content, products, services or privacy policies or practices. These other web sites may send their own cookies to your Device, they may independently collect data or solicit personal information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any site which appears or claims that it is one of the Ollie Services (including those linked to through an email or social networking page).

 INTERNATIONAL TRANSFERS & CONSENT TO PROCESSING

 Ollie is a global business and it, or its service providers, may process, transfer and store information about our users on servers located in a number of countries, including the United States. As a result, your personal information may be subject to data protection and other laws that may differ from your country of residence. Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the countries in which we operate.
